Most conversations about ADA compliance for law firms focus on websites — contact forms, navigation menus, image alt text, and page structure. That’s understandable, because websites are where lawsuits tend to start. But attorneys and law firm administrators increasingly ask a question that doesn’t get much attention: what about email newsletters?

If your firm sends a monthly email update, a practice area roundup, or a client retention newsletter, you may be sending inaccessible content to people who use screen readers, rely on keyboard navigation, or have low vision. Whether that creates legal exposure is a real question, and the answer is more nuanced than most law firm marketing guides acknowledge.

What the Law Actually Says About Email Accessibility?

The Americans with Disabilities Act does not have a specific provision that says “law firm email newsletters must comply with WCAG 2.1.” The DOJ’s March 2024 final rule under Title II focused on state and local government entities, not private businesses. Title III, which applies to places of public accommodation — the category most law firms fall under — still lacks a precise federal technical standard for digital communications like email.

That said, legal exposure does not require a specific rule to exist. Courts have consistently held that the ADA’s broad mandate to provide equal access to goods and services applies to digital content. If a prospective client with a visual disability cannot read your email newsletter because it lacks proper heading structure, has no alt text on images, or contains a call-to-action button that a screen reader cannot interpret, that could constitute a barrier to access. Whether a plaintiff would win such a case depends heavily on the facts, but the risk is real enough that firms should take it seriously.

Why Email Is a Distinct Accessibility Problem?

Email HTML behaves differently than web HTML. Browsers follow standards. Email clients — Outlook, Gmail, Apple Mail, Yahoo — all render HTML in inconsistent ways. This makes building accessible email harder than building an accessible web page. The Web Content Accessibility Guidelines (WCAG) 2.1 are written primarily for web content, though their principles apply directly to email when adapted correctly.

The core issues that make law firm newsletters inaccessible are usually the same ones that cause problems on websites: images without alt text, poor color contrast between text and background, links that say “click here” instead of something descriptive, and layouts that collapse into unreadable columns on mobile devices used with assistive technology. Add to that the fact that many law firm email templates are built around decorative graphics and minimal text, and you have a format that is structurally hostile to screen reader users.

There is also a semantic structure problem specific to email. Many newsletter builders generate HTML with tables for layout — a legacy approach that screen readers parse awkwardly. When a person using JAWS or NVDA opens a newsletter built entirely on nested tables, the reading order can become scrambled. Your main call-to-action might be read before your headline, or navigation links might interrupt the body text.

The Intake Connection You Might Be Missing

Here is where this gets directly relevant to law firm business. Many legal email newsletters include calls to action that link back to intake forms, consultation request pages, or chatbots on your website. If someone reads your newsletter using a screen reader and follows a link to an inaccessible AI contact form or a static intake form with unlabeled fields, the accessibility problem compounds across two channels.

The newsletter gets them interested. The broken form loses them. Worse, if your firm serves a population that includes people with disabilities — and every firm does — an inaccessible intake path is not just a legal risk, it is a real business loss.

Every image in the newsletter needs a meaningful alt text attribute — not “image1.jpg” and not a paragraph of keyword-stuffed text, but a short accurate description of what the image shows and why it is there. Purely decorative images should have an empty alt attribute so screen readers skip them entirely. Text in the body should maintain a contrast ratio of at least 4.5:1 against the background, which is the WCAG 2.1 Level AA standard that most accessibility audits reference.

Link text must describe the destination. “Read our case results” is useful. “Click here” is not. This applies to every button and hyperlink in the newsletter, including unsubscribe links. Heading tags — H1, H2, H3 — should be used in the HTML to structure the content, not just bolded text that looks like a heading but carries no semantic meaning. And the reading order, the sequence in which a screen reader will move through the email, should match the visual order a sighted reader would follow.

Font size matters, too. Body text below 14px creates problems for users with low vision who are not using screen magnification. Many law firm newsletters use small print for disclaimers or footer content. That content may be legally required, so making it readable is doubly important.

Does Your Email Platform Support Accessible Output?

Most major email platforms — Mailchimp, Constant Contact, HubSpot, Klaviyo — support the technical requirements for accessible email if you use them correctly. The platforms do not automatically make your newsletters accessible. They give you the tools; you have to apply them.

Some platforms offer built-in accessibility checkers before sending. These are worth using, but treat them as a starting point. Automated scanners catch obvious problems like missing alt text or low contrast, but they cannot evaluate whether your content is logically structured or whether your link text is meaningful in context. Start by auditing your last three newsletters. Run the HTML through an accessibility checker, check your image alt text, test your color contrast ratios using a free tool like WebAIM’s contrast checker, and read through every link in the email to confirm the anchor text describes the destination. If you use a template, audit the template itself — problems baked into the template repeat with every send.
