1. Who We Are

Acute SEO, LLC, doing business as Acute SEO AI (“Company,” “we,” “us,” or “our”) operates acuteseoai.com and provides AI-powered lead generation and accessibility compliance products including the Conversion System (AI Chatbot + AI Contact Form, offered under our Conversion Plans) and AI Accessibility (ADA Website Compliance, offered under our Compliance Plans). Our business is located in Reno, Nevada.

2. Information We Collect

We collect information in the following ways:

Information You Provide Directly:

• Name, email address, phone number, and business name when you request a demo, create an account, or contact us
• Payment and billing information when you subscribe to our Services
• Business details you provide during AI intake setup (services, locations, pricing, FAQs)
• Communications you send to us via email, phone, or chat
• Mobile phone numbers (when provided by business clients for SMS lead notifications — see Section 5)

Information Collected Automatically:

• Browser type, operating system, device information, and IP address
• Pages visited, time spent on pages, and referring URLs
• Cookies and similar tracking technologies (see Section 7)

Information from AI Intake Interactions:

• Conversations between website visitors and your AI intake system, including messages, timestamps, and lead information submitted by visitors
• UTM parameters and referral source data attached to intake sessions

Information from Third Parties:

• Analytics data from platforms such as Google Analytics
• Payment confirmation from payment processors

3. How We Use Your Information

We use the information we collect to:

• Provide, maintain, and improve our Services
• Process payments and manage your account
• Build and configure your AI intake system based on your business information
• Deliver leads captured by your AI intake system to you via email, dashboard, or integration
• Generate AI-powered blog content and schema markup for your website
• Send you service updates, invoices, and essential communications
• Respond to your inquiries and provide customer support
• Analyze usage patterns to improve our products
• Comply with legal obligations

We do not sell your personal information to third parties.

4. How We Share Your Information

We may share your information in the following circumstances:

• AI Service Providers: Chatbot conversations, lead summaries, and translation requests are processed by Anthropic (primary) and OpenAI (fallback) via their respective APIs. These interactions are subject to each provider’s data processing terms.
• Email Delivery Provider: Elastic Email — transactional email delivery for lead notifications, welcome emails, invoice emails, and password resets.
• SMS Delivery Provider: Twilio Inc. — SMS delivery for transactional lead notifications sent to business clients (see Section 6).
• Payment Processors: Stripe handles credit and debit card subscription billing; ACH payments are processed through our bank. Stripe is PCI-DSS compliant and stores card data on our behalf; we do not store card data directly.
• WordPress & Hosting: Plugin data is stored on your own WordPress installation and web host. We do not control your hosting environment.
• Analytics Providers: We may use services like Google Analytics to understand how our Site is used. These providers have their own privacy policies.
• Legal Requirements: We may disclose information if required by law, court order, or government regulation, or if we believe disclosure is necessary to protect our rights, safety, or property.
• Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

5. SMS Lead Notifications

Acute SEO AI offers an optional SMS lead notification service to business clients who use our AI Chatbot, AI Contact Form, or related lead capture products. This section describes how that service works.

What we collect: When a business client (the account owner or designated staff) wants to receive SMS alerts about new leads captured on their website, they enter one or more mobile phone numbers into the “Notification Phones” field in their Acute SEO AI account dashboard.

How we use it: When a visitor submits a lead through one of our products on the client’s website, we send a transactional SMS notification to each phone number listed in that client’s Notification Phones field. The message contains the lead’s name, contact information, and a link to view the full lead in the Acute SEO AI dashboard. These messages are transactional account notifications, not marketing communications.

How you opt in: By entering a phone number into the Notification Phones field of your Acute SEO AI account dashboard, you consent to receive transactional SMS lead notifications at that number. Only the account owner or authorized staff with dashboard access can add phone numbers.

How you opt out: You can stop receiving SMS lead notifications at any time by either (a) replying STOP to any message you receive from us, which will automatically and permanently unsubscribe that phone number from all future messages, or (b) removing the phone number from the Notification Phones field in your account dashboard. You may also reply HELP at any time to receive instructions for contacting support.

Message frequency: Message frequency varies based on the volume of leads submitted through your website. You will receive one SMS per lead, per phone number on the notification list.

Costs: Acute SEO AI does not charge you for SMS notifications. However, message and data rates may apply from your mobile carrier. Acute SEO AI is not responsible for carrier charges.

Carrier disclaimer: Mobile carriers are not liable for delayed or undelivered messages.

Third parties: We use Twilio Inc. as our SMS delivery provider. Twilio processes phone numbers and message content solely for the purpose of delivering the messages on our behalf and is bound by their own privacy policy and our service agreement. We do NOT sell, rent, lease, or share Notification Phone numbers with any other third party for any purpose. Phone numbers collected for SMS lead notifications are used exclusively for delivering those notifications.

6. AI Intake Data and Your Visitors

When you use AI Lead Capture on your website, your website visitors interact with the AI intake system and may provide personal information (name, email, phone number, case details, etc.). Important disclosures:

• You are the data controller for information collected from your website visitors through the AI intake system.
• We process this data on your behalf as a data processor.
• Conversation data is stored securely and accessible through your client dashboard.
• It is your responsibility to disclose the use of an AI-powered intake system on your website and to comply with all applicable privacy laws regarding your visitors’ data.
• We recommend adding a notice to your own privacy policy informing visitors that an AI-powered intake system is in use and how their data is handled.

7. Cookies and Tracking

Our Site uses cookies and similar technologies to:

• Remember your preferences and login sessions
• Analyze site traffic and usage patterns
• Track the effectiveness of marketing campaigns (UTM parameters)
• Deliver a functional chatbot experience

You can manage cookie preferences through your browser settings. Disabling cookies may affect the functionality of certain features on our Site.

We do not use cookies for behavioral advertising or sell cookie data to third parties.

8. Data Security

• Account data is retained while your subscription is active and for up to 12 months after cancellation.
• Chatbot conversation data is retained while your subscription is active. Upon cancellation, conversation data is deleted within 90 days unless you request earlier deletion.
• Billing records are retained for up to 7 years for tax and accounting purposes.
• Analytics data is retained in aggregated, anonymized form indefinitely.

10. Your Rights

Depending on your location, you may have the following rights regarding your personal information:

• Access: Request a copy of the personal information we hold about you.
• Correction: Request that we correct inaccurate or incomplete information.
• Deletion: Request that we delete your personal information, subject to legal retention requirements.
• Portability: Request your data in a commonly used, machine-readable format.
